The Massachusetts Uniform Probate Code (MUPC) provides for appointment of a temporary guardian when the court finds that waiting for the permanent order would “result in immediate and substantial harm to the health, safety [or] welfare” of the alleged incapacitated person – that is an emergency. Chapter 190B § 5-308. Likewise, a temporary conservatorship may be ordered in immediate or urgent situations to protect the person’s property, income or entitlements.
Temporary guardianships and conservatorship are in effect for 90 days but they may be extended.
